תנאים והגבלות סטריט קארט / Street Kart Terms & Conditions

המשתמש מסכים לציית ל"תנאים והגבלות" אלה בעת השתתפות בשירותים המסופקים על ידי החנות. שירותים לא יסופקו ללא הסכמה בשום נסיבות.

The User agrees to comply with these "Terms and Conditions" when participating in services provided from the Shop. Services will not be provided without agreement under any circumstance.

המשתמש חייב לעמוד בחמשת התנאים הבאים. אם המשתמש נכשל בהתאמה לאחד מהתנאים, המשתמש לא יורשה להשתמש בשירות. אם נמצא שהמשתמש משתמש בשירות למרות שאינו עומד בתנאים, המשתמש מכיר שהביטוח לא יחול.

The User must fall under the following 5 conditions. If the User fails to fall under with either 1 of the conditions, the User will not be allowed to use the service. If the user is found to be using the service even though the User does not fall under the conditions, then the User acknowledges that insurance will not apply.

  The User must be over 18 years of age.
• המשתמש חייב להחזיק ברישיון נהיגה תקף או היתר לנהיגה ביפן (רישיון נהיגה בינלאומי מבוסס על אמנת ג'נבה משנת 1949, רישיון SOFA וכו').
  
  The User must have a valid driver's license or permit to drive in Japan (International Driving Permit based on 1949 Geneva Convention, SOFA license, etc.).
• המשתמש חייב להיות בעל מיומנות נהיגה מספקת כדי להשתמש בשירות.
  
  The User must have sufficient driving skill to use the service.
• המשתמש חייב להבין ש-StreetKart הוא מותג נפרד ועצמאי ואין לו שום זיקה ל-Nintendo ו/או לזיכיון 'Mario Kart'.
  
  The User must understand that StreetKart is a distinct and independent brand and has no affiliation with Nintendo and/or the 'Mario Kart' franchise.
• המשתמש חייב להיות בעל שימוש מלא בשתי הידיים/זרועות והרגליים/רגליים כדי להפעיל את הקארט.
  
  The User must have full use of both hands/arms and feet/legs in order to operate the kart.

המשתמש חייב לציית לכל חוקי התנועה המקומיים והלאומיים. המשתמש חייב להחזיק ברישיון נהיגה תקף או היתר לנהיגה ביפן ולשאת אותו בכל עת. המשתמש חייב להיות בעל כישורי נהיגה מספיקים לנהיגה בקארט.

Users must comply with all local traffic laws and regulations. Users must possess and carry at all times a valid driver's license or permit to drive in Japan. Users must have sufficient driving skills to operate a kart.

ביפן, על פי חוק, באחריות המשתמש לוודא שהקארט ניתן להפעלה ללא תקלות המפרות כל חוקי תנועה מקומיים. (דוגמה: אור איתות צד, פנסים קדמיים, פנסים אחוריים, אורות בלמים, בלמים, האצה)

In Japan, it is the user's responsibility by law to ensure that the kart is roadworthy and free from malfunctions that would violate local traffic laws (e.g., side signal lights, headlights, taillights, brake lights, brakes, accelerator).

כל משתמש יהיה אחראי לכל הפרות תנועה. החנות או המדריך לא יהיו אחראים לכל קנס או עמלה שייגרמו מההפרה.

Each user is responsible for any traffic violations. The shop or tour guide is not responsible for fines or fees incurred due to violations.

החנות עשויה לחייב כל קנסות או עמלות לא פתורים שנגרמו על ידי המשתמש בקשר להפרות תנועה עם הרשויות המקומיות.

The shop may charge users for unresolved fines or fees incurred regarding traffic violations with local authorities.

במקרה של תאונת דרכים, המשתמש חייב להודיע למדריך הטיול, הרשויות המקומיות וחברת הביטוח.

In the event of a traffic accident, the User must immediately notify the tour guide, local authorities, and insurance company.

המשתמש מסכים לא להיכנס להסכם פשרה עם הצד שכנגד ללא הסכמת StreetKart.

In the event of a traffic accident, the User agrees not to enter into a settlement agreement with the opposing party without StreetKart's consent. StreetKart will not be liable for any settlement agreement made between the User and the opposing party without the consent of StreetKart.

כל הקארטים מבוטחים במקרה של תאונה. כיסוי הביטוח מוגבל ומוסדר. במקרה של תאונה, חברת הביטוח תעריך את התקרית. ברגע זה, המשתמש חייב לשלם כתב ויתור של 50,000 ין יפני. אם חברת הביטוח מעריכה שהתאונה היא תוצאה של נהיגה פזיזה, המשתמש עלול להיות זנוח מכיסוי.

All Karts are insured in case of an accident. However, the coverage of the insurance is limited and regulated. In an event of an accident, the insurance company will evaluate the incident. At this moment, the User must pay a deductible of 50,000 Japanese Yen. If the insurance company evaluates the accident is as a result of reckless driving, the User will be denied coverage.

המשתמש אחראי לכל נזק לקארטים. המשתמש מבין שהחנות תגבה עבור נזקים בפועל. כל נזקים הכוללים את חברת הביטוח יעקבו אחרי סעיף 9. לחנות יש את הזכות לתבוע נזקים.

The User is responsible for any damages to the karts. The User understands that the Shop will charge for actual cost of repairs. Any damages involving the insurance company will follow Clause 09. The Shop has the right to claim for damages.

המשתמש מסכים שהוא אינו חבר בארגון פלילי ואינו משתתף בפעילות פלילית.

The User agrees that they are neither a member of a criminal organization nor are they participating in criminal activity.

המשתמש אינו רשאי לאפשר לאף אדם אחר לנהוג או לנסוע בקארט, אלא אם צוין במפורש על ידי החנות או המדריך.

The User may not permit anyone else to drive or ride the kart, unless explicitly specified by the Shop or the tour guide.

הקארטים, כשהם מושכרים, לא יורשו לשמש מסחרית (שירות שליחים, פרסום) אלא אם כן ניתן על ידי החנות.

The karts, when rented, shall not be permitted for commercial use, such as courier service or advertisement, unless permission is granted by the Shop.

בנוגע ללקוחות טיולים, משתמשים לא יהיו אחראים למילוי המיכלים לאחר סיום הטיול. בנוגע להשכרות עצמאיות, למעט תחזוקה הכרחית, המשתמש לא רשאי לשנות את הרכב, כגון על ידי הצמדת מדבקות או התקנת מכשירים, וכו', ללא הסכמת החנות. יתר על כן, הרכב וכו' חייב להיות מוחזר במצבו המקורי והמשתמש חייב למלא מחדש את מיכל הדלק שלו לפני החזרתו. אם המשתמש לא מחזיר את הרכב עם מיכל מלא, עליו לשלם את האגרה שנקבעה על ידי החנות.

Regarding Tour customers, users will not be liable for filling the tanks after the tour has finished. For freelance rentals, the User must not modify the vehicle in any way (e.g. attaching stickers, installing devices, etc.) without consent from StreetKart. Standard necessary maintenance is an exception to this clause.

בנוגע ללקוחות טיולים, סעיף זה לא חל. בנוגע להשכרות עצמאיות, המשתמש מחויב להחזיר את הרכב וכו' במקום ובזמן שנקבעו על ידי החנות. אם המשתמש חורג מזמן ההשכרה, עליו לקבל את הסכמת החנות ולשלם דמי איחור.

This clause does not apply to guided tour customers. Regarding freelance rentals, the User is committed to returning the Vehicle, etc. at to the place and at the time prescribed by the Shop. If the User exceeds the rental time, they must obtain the consent of the Shop and pay a late fee.

המשתמש מסכים לא להעלות שום טענה לזכויות יוצרים, דיוקן ופרסום הקשורות לתצלומים הקשורים לשימוש בקארטים ושירותים הניתנים.

The User agrees to make no claim whatsoever to copyright, portrait rights, or publicity rights related to photographs or media related to the usage of the karts and services provided.

אם המשתמש מפר את התנאים וההגבלות האלה, המשתמש מכיר בפיצוי כל תביעות שהחנות תעלה בנוגע לנזקים או קנסות הפרה.

If the User violates these Terms and Conditions, the User acknowledges and agrees to compensate StreetKart for any claims regarding damages or violation penalties.

המשתמש מבין שלחנות ולמדריך הטיול יש את הזכות והסמכות להשעות משתמש בודד מנהיגה בקארט בהתאם לסיכוני בטיחות (נהיגה פזיזה, אי ציות לכללי הטיול וכו'). המשתמש יחזיר את הקארט כפי שצוין על ידי החנות או מדריך הטיול.

The User understands that the Shop and tour guide have the right and authority to suspend an individual user from driving a kart depending on safety risks, including, but not limited to, reckless driving or not complying with tour rules. The User will return the kart as specified by the Shop or tour guide.

החנות לא תהיה אחראית ו/או אחראית לכל נזק שנגרם למשתמש. לחנות יש את הזכות להשעות, לבטל ולשנות את השירות הניתן למשתמש.

The Shop will not be responsible and/or liable for any damages caused to the User. The Shop has the right to suspend, cancel, and change the service provided to the User.

המשתמש לא יכול לאסוף נתונים, מידע ותמונות ביחס לכל הפצת מדיה. המשתמש לא יכול לאסוף נתונים ללא רשות החנות.

The User may not collect data, information, or images in relation to any media distribution. Furthermore, the User cannot collect any data without the express permission of the Shop.

המשתמש מבין שהתנאים וההגבלות עלולים להתעדכן ללא הודעה או אישור מהמשתמש.

The User understands that the Terms and Conditions may be updated without noticing or approval from the User.

אנו מאמינים ששיתוף ודיון בחוויות נסיעה עם אחרים הוא אחד השמחות האמיתיות של טיול.

We do not verify whether you actually talk about or share your experience. It is determined solely by whether you wish to keep your experience confidential.
This pricing system does not offer a discount; it is an additional charge for the confidentiality option.
